In my law school youth, it became axiomatic: The Law cannot read the subjective intent of an individual, but can only judge the objective intent as shown by the actions of the parties.

In either case, my attack is against the "Ponzi" host. The same argument prevails for taking down the conspiracy site. (I looked at "Ponzi's" other postings. A lot of weird, conspiracy theories.)

I agree. Conspiracy sites have done too much damage already.
